## 📌 案件背景

2024年3月，Tina Cavalleri、Mark Glinoga同Mengyao Yang喺舊金山地方法院入稟，指控愛馬仕採用「捆綁銷售」（tying）手法，要求顧客先購買其他產品（例如圍巾、珠寶）儲夠「消費額=配貨」，先有機會買鉑金包。佢哋形容呢個制度係「隱形抽籤系統」，認為違反美國《謝爾曼反壟斷法》同加州相關法律\[1\]。😶

## ⚖️ 法院917裁決

法官James Donato唔認同原告講法，喺2025年9月17日正式「with prejudice」駁回訴訟，代表原告唔可以再翻案\[2\]。判詞指出：「It may be, as plaintiffs suggest, that Hermès reserves the Birkin bag for its highest-paying customers, but that in itself is not an antitrust violation.」即係話，就算愛馬仕優先畀高消費顧客買包，都唔構成違法\[3\]。

事實上，Donato早喺2024年9月案件管理會議已經講過：「Hermès can run its business however it sees fit.」強調品牌有權制定自己嘅銷售策略\[4\]。

##  📜 雙方角力

原告喺2024年5月同10月兩度修改訴狀，試圖證明愛馬仕嘅銷售方式損害市場競爭，但最終都無法說服法庭\[5\]。愛馬仕方面則回應，佢哋嘅銷售模式喺競爭激烈嘅奢侈品市場中完全合法\[6\]。

呢場官司正式落幕，愛馬仕嘅鉑金包銷售策略獲法院認可，無被判違法，亦突顯奢侈品市場獨有嘅運作方式。香港嘅包迷如果想入手鉑金包，除咗銀包要夠脹 ，同品牌保持友好關係都係一門學問！😉
